第二十三章 居間合同
第四百二十四條 居間合同是居間人向委托人報告訂立合同的機會或者提供訂立合同的媒介服務，委托人支付報酬的合同。
第四百二十五條 居間人應當就有關訂立合同的事項向委托人如實報告。
居間人故意隱瞞與訂立合同有關的重要事實或者提供虛假情況，損害委托人利益的，不得要求支付報酬并應當承擔損害賠償責任。
第四百二十六條 居間人促成合同成立的，委托人應當按照約定支付報酬。對居間人的報酬沒有約定或者約定不明確，依照本法第六十一條的規定仍不能確定的，根據居間人的勞務合理確定。因居間人提供訂立合同的媒介服務而促成合同成立的，由該合同的當事人平均負擔居間人的報酬。
居間人促成合同成立的，居間活動的費用，由居間人負擔。
第四百二十七條 居間人未促成合同成立的，不得要求支付報酬，但可以要求委托人支付從事居間活動支出的必要費用。
附 則
第四百二十八條 本法自１９９９年１０月１日起施行，《中華人民共和國經濟合同法》、《中華人民共和國涉外經濟合同法》、《中華人民共和國技術合同法》同時廢止。
